For the fees described on the prices page, DecoWare provides you with a bespoke website containing the facilities described below:
A unique URL in the format xxxxx.decoware.co.uk. Where xxxxx is a name that you choose from those that are available and subject to our approval.
A publicly available seven page website, the pages containing the following information about your business, as follows:
You are responsible for supplying the content for the following pages: Home Page; About Us Page; History Page; Links Page; Contact Page.
We will set up your website with default content for the foregoing until you supply us with the relevant information.
By default the payment page is set up to use a PayPal account, although other payment gateways are supported. Please enquire as to the availability if you wish to use a different payment gateway.
DecoWare acts as an Internet service provider by creating, hosting, maintaining and providing our Service to you via the Internet.
To be eligible for a website, you must be a resident of the United Kingdom.
All services may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any laws is prohibited. We will be the sole arbiter as to what constitutes a violation of this provision.
You agree not to continue to send commercial e-mail to a recipient if recipient has requested that you discontinue such communication.
We reserves the right, at our sole discretion to deactivate your web hosting upon non payment of fees due.
You may not supply for publication on your website material that could be infringing on a third party's copyright.
We shall have no liability, directly or indirectly, to Complainants or third parties for your infringing copyrighted materials. You shall reimburse us for all expenses associated with processing valid infringement allegations and defending any and all legal claims associated therewith.
The hosting service is provided on an "as is" basis. We give no warranty, expressed or implied, for the web hosting services provided, including, without limitation, warranty of merchantability and warranty of fitness for a particular purpose. This no warranty expressly includes any reimbursement for losses of income due to disruption of service by us or our providers beyond the fees you pay us for services.
We are not responsible for any damages arising from your use of our systems or by your inability to use the services for any reason.
You are solely responsible for backup of data stored on the web server.
You hereby agree that any material submitted for publication through this service will not contain anything leading to an abusive or unethical use of the service. You agree to indemnify and hold harmless DecoWare from any claim resulting from your publication of materials or your use of those materials. We may or may not give notice before deactivating the use of a website which we decide is an unethical use of the service.
We maintain control and ownership of any and all URLs ending decoware.co.uk that may be assigned to you.
If we cancel your account for any reason any amounts owed in arrears will be made due and payable immediately.
You agree to defend, hold harmless, and expeditiously indemnify us from any and all liability, claim, loss, damage or expense arising out of your breach or violation of any covenant contained in this Policy, or resulting from your use of the service.
Indemnification. You agree to indemnify and hold us harmless from any claim or demand made or incurred by any third party due to or arising out of your breach of these terms, or your violation of any law or the rights of a third party relating to your use of the Service.
You agree to waive and hold us harmless from any claims relating to any action taken by us as part of an investigation into a suspected violation of this Policy or as a result of its conclusion that a violation of this Policy has occurred. Therefore, you cannot sue or recover any damages whatsoever from us as a result of the decision to remove material from our server, or to suspend or terminate your account.
You may not transfer any rights or obligations you may have under this Agreement without our prior written consent. We reserves the right to transfer this Agreement or any right or obligation under this Agreement without your consent.
Use of any information obtained from our customers websites is at your own risk. We specifically deny any responsibility for the content of websites created through this service.
We have a policy to respect and protect the privacy of our customers and their information that is stored online. We will only access and disclose information as necessary to comply with applicable laws and government requests, to provide the Services described, to operate or maintain its systems or to protect itself or its customers.
In no event shall we be liable for losses of any kind arising out of or in connection with our website.
All fees are in Pounds, Sterling.
This Agreement is governed by and interpreted under the laws of the United Kingdom.
